Refund policy

RETURNS AND WARRANTY POLICY

 

1.1.  Tower Garden LLC is proud of the quality of its Products (“Products”) and certifies that the Products meet high regulatory standards for consumer use. Tower Garden Products are distributed in Europe by The Juice Plus+ Company which is an affiliate company (referred to as “Tower Garden” "we" or “us” in this policy). 

1.2.  If a Customer is not satisfied with a Product, the Customer may contact our Customer Service team by email customercare.emea@towergarden.com to request return of a Product and a refund. 

1.3.  The Customer acknowledges and agrees that the Customer has a statutory right to cancel the Order without any reason within 14 (fourteen) days from the day the Product is delivered.  Provided the Products are unopened and unused - a full refund will be provided. 

1.4.  In addition, Tower Garden offers an enhanced returns policy whereby Tower Garden Products (including products that have been opened and/or used) may be returned to us within 60 (sixty) days from the original shipment date and in such cases the purchase price will be refunded, less a restocking fee of £50. 

1.5.  Tower Garden will refund the purchase price of Tower Garden Products returned in accordance with this policy (less the restocking fee of £50 (where applicable)) on the same payment method that the Customer used, unless otherwise agreed in writing. 

1.7.  The Customer acknowledges and agrees that any termination request outside the time frames in this returns policy will be considered on a case-by-case basis. 

Limited Warranty

Products will be free from defects in materials or workmanship under the following warranty provisions:

(a) CORE COMPONENTS – For a period of Five Years from the date of purchase by the original retail customer, we will repair or replace (at our option) any defective original core plastic component, which are the Nutrient Reservoir, Reservoir Lid, Access Port Lid, Tower Sections, Shower Cap, Shower Cap Lid, Pump and Timer.

(b) OTHER COMPONENTS – For One Year from the date of purchase by the original retail customer, we will repair or replace (at our option) any defective original component not covered under the warranty above, including LED Grow Lights, excluding Consumables.

Within the warranty period, we will, at our sole option, repair or replace any components that fail in normal use and, which upon inspection if requested by us show to be defective in materials or workmanship. Such repairs or replacements will be made at no charge to the Customer and we will arrange for the requested return of any defective components free of charge. We will also arrange delivery of the repaired or replacement component to the Customer free of charge. 

HOW TO OBTAIN WARRANTY SERVICE: To obtain warranty service, email Tower Garden Customer Care within the warranty period for instructions.

WARRANTY LIMITATIONS: This limited warranty does not apply to: (i) damage caused by accident, misuse, abuse, alteration, improper assembly or installation, negligence in use, or acts of nature or other external causes; (ii) components considered to be consumable items; (iii) normal wear and tear, or (iv) products purchased for commercial or industrial use.

THIS LIMITED WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE. THE TERMS IMPLIED BY SECTIONS 13 TO 15 OF THE SALES OF GOODS ACT 1979 ARE, TO THE FULLEST EXTENT PERMITTED BY LAW, EXCLUDED FROM THIS CONTRACT. THIS LIMITED WARRANTY ALSO APPLIES TO ANY REPAIRED OR REPLACED GOODS SUPPLIED BY US TO YOU. 

OUR SOLE LIABILITY, AND THE SOLE REMEDY, FOR BREACH OF THIS WARRANTY IS LIMITED TO THE REPAIR OR REPLACEMENT OF ANY DEFECTIVE COMPONENT (AT OUR SOLE OPTION). OUR REPRESENTATIVES, EMPLOYEES AND AFFILIATES ARE NOT AUTHORIZED TO MAKE MODIFICATIONS TO THIS LIMITED WARRANTY OR MAKE ADDITIONAL WARRANTIES BINDING ON US. ACCORDINGLY, ADDITIONAL STATEMENTS BY ANY SUCH PERSONS, WHETHER ORAL OR WRITTEN, DO NOT CONSTITUTE WARRANTIES BY US AND SHOULD NOT BE RELIED UPON. WE DO NOT WARRANT THAT THE PRODUCT WILL MEET YOUR NEEDS OR EXPECTATIONS. THIS LIMITED WARRANTY IS NOT VALID UNLESS THE PRODUCT IS PURCHASED FROM US. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE ADDITIONAL RIGHTS, WHICH MAY VARY FROM JURISDICTION TO JURISDICTION. SOME JURISDICTIONS DO NOT ALLOW SUCH WARRANTY LIMITATIONS, SO THE ABOVE LIMITATIONS MAY NOT APPLY. IN NO EVENT SHALL WE BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES RESULTING FROM A DEFECTIVE COMPONENT OR THE MISUSE OF THE PRODUCT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF INCIDENTIAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION MAY NOT APPLY.
